Terms of Service
1. What this platform is
My Grow Community ("the Platform") is a peer-to-peer community marketplace for sharing, trading, donating, and selling small quantities of home-grown produce, plants, seeds, and garden supplies. We are NOT a certified farmers market, a food distributor, a payment processor of record, or a party to any transaction between users.
2. Account eligibility
You must be 18 or older. You must provide accurate information and may not impersonate others. You are responsible for everything that happens under your account.
3. Your responsibilities as a user
You agree to:
- Follow all applicable federal, state, and local laws, including food-safety, agricultural-sales, sales-tax, and licensing rules.
- Be truthful in every listing, message, comment, review, and report.
- Treat other community members with respect.
- Use the Platform only for the purposes it is designed for.
4. Your responsibilities as a seller, sharer, or donor
By posting a listing, you represent that:
- You grew the produce yourself OR you obtained it legally and have the right to sell, share, or donate it.
- The item is whole and uncut, not spoiled, and complies with the Prohibited Items policy.
- You are not making medical, health, or nutrition claims.
- You will handle the item safely from harvest through hand-off.
- You understand you are personally responsible for the item, the transaction, and any tax obligations that flow from it.
5. Payments
The Platform does not currently process payments. Buyers and sellers handle payment off-platform. You are responsible for any taxes owed on transactions you conduct, regardless of how payment is arranged.
If we later add in-platform payments, separate payment terms will apply and you will be asked to accept them.
6. Prohibited items and conduct
You may not list, share, donate, or solicit anything on our Prohibited Items list. You may not harass, threaten, defraud, spam, or attempt to circumvent the platform's contact filters. We reserve the right to remove content, suspend accounts, and report illegal conduct to authorities.
7. The Platform is provided "as is"
We do not inspect, verify, test, or guarantee any listing, user, or transaction. We do not certify food safety. We do not guarantee that any meet-up will be safe. Use the Platform at your own risk. We disclaim all warranties to the fullest extent permitted by law.
8. Limitation of liability
To the fullest extent permitted by law, the Platform's total liability for any claim arising from your use of the Platform is limited to the greater of (a) the fees you paid us in the prior 12 months, or (b) US $100. We are not liable for indirect, incidental, consequential, or punitive damages, including foodborne illness, allergic reactions, property damage, lost profits, or emotional distress.
9. Indemnification
You agree to defend, indemnify, and hold harmless the Platform and its operators from any claim arising out of your use of the Platform, your listings, your conduct, or your violation of these Terms.
10. Termination
We may suspend or terminate your account at any time, with or without notice, for any reason.
11. Changes to these Terms
We may update these Terms. Material changes will be re-prompted in-app and your continued use after acceptance constitutes agreement.
12. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute will be resolved in state or federal courts located in California.
